IMPORTANT: THE THEHABBOIMAGER END-USER LICENSE AGREEMENT ("EULA") IS A LEGAL AGREEMENT BETWEEN YOU (EITHER AN INDIVIDUAL OR, IF PURCHASED OR OTHERWISE ACQUIRED
BY OR FOR AN ENTITY, AN ENTITY) AND JORDANTBH TECHNOLOGIES. READ IT CAREFULLY BEFORE COMPLETING THE INSTALLATION PROCESS AND USING THE SOFTWARE. IT PROVIDES A
LICENSE TO USE THE SOFTWARE AND CONTAINS TERMINATION AND WARRANTY INFORMATION AND LIABILITY DISCLAIMERS. BY INSTALLING AND USING THE SOFTWARE, YOU ARE CONFIRMING
YOUR ACCEPTANCE OF THE SOFTWARE AND AGREEING TO BECOME BOUND BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS, THEN DO NOT INSTALL THE
SOFTWARE.
THIS EULA SHALL APPLY ONLY TO THE SOFTWARE "THEHABBOIMAGER" SUPPLIED BY JORDANTBH TECHNOLOGIES. HEREWITH REGARDLESS OF WHETHER OTHER SOFTWARE IS REFERRED TO OR
DESCRIBED HEREIN.
The Software is supplied by JordanTBH Technologies and is licensed, not sold, under the terms of this EULA and JordanTBH Technologies reserves all rights not
expressly granted to you. JordanTBH Technologies retains the ownership of the Software.
1. Software License:
a. JordanTBH Technologies grants you a license to use one copy of the Software. You may not modify or disable any licensing or control features of the Software.
b. This Software is licensed to operate on only on Windows OS.
c. This Software is licensed to operate on the Windows x Operating System, Only Windows users may use this product for its intended purpose on the OS. You may
not sell the products or services of other companies in the capacity of an on-line mall or buyer service. If you wish to use the product on another OS you must
download it from the download centre.
a. By accepting this EULA you are agreeing not to reverse engineer, decompile, or disassemble the Software Application, except and only to the extent that such
activity is expressly permitted by applicable law notwithstanding this limitation.
b. You are the exclusive licensee of the Software and sharing any source code of the Software with any individual or entity is a violation of copyright laws and
international treaties and cause for license termination.
c. Modifying any portion of the Software source code or asking any individual or entity to modify the Software source code other than JordanTBH Technologies is a
violation of copyright laws and international treaties and cause for license termination.
d. If you upgrade the Software to a higher version of the Software, this EULA is terminated and your rights shall be limited to the EULA associated with the
higher version.
e. JordanTBH Technologies ("WE" or "US") products are not sold elsewhere you can only order copies of JordanTBH Technologies products from our official sites.
f. Proprietary Rights: All title and copyrights in and to the Software (including, without limitation, any images, photographs, animations, video, audio, music,
text, and "applets" incorporated into the Software Application), the accompanying media and printed materials, and any copies of the Software are owned by
JordanTBH Technologies. The Software is protected by copyright laws and international treaty provisions. Therefore, you must treat the Software like any other
copyrighted material, subject to the provisions of this EULA.
THE SOFTWARE AND DOCUMENTATION ARE LICENSED "AS IS," AND JORDANTBH DISCLAIMS ANY AND ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT
LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE EXTENT AUTHORISED BY LAW. WITHOUT LIMITATION OF THE FOREGOING,
JORDANTBH EXPRESSLY DOES NOT WARRANT THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS OR THAT OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR FREE. YOU
ASSUME RESPONSIBILITY FOR SELECTING THE SOFTWARE TO ACHIEVE YOUR INTENDED RESULTS, AND FOR THE RESULTS OBTAINED FROM YOUR USE OF THE SOFTWARE. YOU SHALL BEAR THE
ENTIRE RISK AS TO THE QUALITY AND THE PERFORMANCE OF THE SOFTWARE.
UNDER NO CIRCUMSTANCES WILL JORDANTBH OR ITS AUTHORIZED REPRESENTATIVES BE LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, SPECIAL, PUNITIVE, EXEMPLARY OR INCIDENTAL
DAMAGES, WHETHER FORESEEABLE OR UNFORESEEABLE, BASED ON CLAIMS BY CUSTOMER OR ANY THIRD PARTY (INCLUDING, BUT NOT LIMITED TO, CLAIMS FOR LOSS OF DATA, GOODWILL,
PROFITS, USE OF MONEY OR USE OF THE PRODUCTS, INTERRUPTION IN USE OR AVAILABILITY OF DATA, STOPPAGE OF OTHER WORK OR IMPAIRMENT OF OTHER ASSETS), ARISING OUT OF
BREACH OF EXPRESS OR IMPLIED WARRANTY, BREACH OF CONTRACT, BREACH OF ANY INTELLECTUAL PROPERTY RIGHT, MISREPRESENTATION, NEGLIGENCE, STRICT LIABILITY IN TORT OR
OTHERWISE, EXCEPT ONLY IN THE CASE OF PERSONAL INJURY WHERE AND TO THE EXTENT THAT APPLICABLE LAW REQUIRES SUCH LIABILITY. IN NO EVENT WILL THE AGGREGATE
LIABILITY INCURRED IN ANY ACTION OR PROCEEDING BY JORDANTBH OR ITS AUTHORIZED REPRESENTATIVE EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY CUSTOMER FOR THE SPECIFIC
LICENSED SOFTWARE THAT DIRECTLY CAUSED THE DAMAGE.
JordanTBH Technologies is not responsible for problems resulting from improper or inadequate maintenance or configuration; software or interface routines or
functions NOT developed by JordanTBH; unauthorized specifications for the Software; improper site preparation or maintenance; Beta Software; encryption
mechanisms or routines.
5. Distribution and Backups:
a. DISTRIBUTION OF THE REGISTERED VERSION OF THE Software IS STRICTLY PROHIBITED and is a violation of copyright laws and international treaties punishable by
severe criminal and civil penalties.
b. You may make copies of the Registered Version of the Software for backup purposes only. All backup copies must be an exact copy of the original Software.
12. Refunds Policy: Refunds are only issued for software failure. Refunds are not issued for server failure/issues, lack of features or if your server does not
meet the Software Requirements. Refunds are determined on individual circumstances and only issued once our technical staff determine that JordanTBH has a fault
causing it to not run on your server. Installation charges are not refundable under any circumstances. Refunds are not available after 1 month from purchase
date.
13. If any provision of this EULA shall be prohibited by law or adjudged by a court to be unlawful, void or unenforceable such provision shall to the extent
required be severed from this EULA and rendered ineffective as far as possible without modifying the remaining provisions of this EULA and shall not in any way
affect any other circumstances of or the validity or enforcement of this EULA.
14. JordanTBH Technologies undertakes to comply with the provisions of the Data Protection Act 1998 and any related legislation in so far as the same relates to
the provision of the Software and related support services by JordanTBH Technologies to you.
Your name, address and other personal information as well as any personal data you supply to JordanTBH Technologies in order for JordanTBH to provide the
Software and related services related to you will be stored by JordanTBH Technologies on its computer system and may be made available to JordanTBH staff and
related third parties as required to allow the provision of support and any related services to be completed. Any third party that receives personal data from
JordanTBH Technologies is under an obligation to process such personal data in line with the Data Protection Act 1998.
15. Each party irrevocably agrees that the courts of the country of England shall have exclusive jurisdiction to resolve any controversy or claim of whatever
nature arising out of or in relation to this EULA and the place of performance of this EULA shall be England and that the laws of that country shall govern such
controversy or claim.
If you do not agree to the terms of this end-user license agreement ("EULA") do not download, install or use this product.
JordanTBH Technologies respects your privacy and will ensure that all personal information being voluntarily submitted to us in the processing of your order will
be kept strictly confidential and used solely by us, our authorized dealers (Enom etc) and employees. We only use this data for the strict purpose for which it
was intended, and for the benefit of the clients.
We will not share, rent, sell or release information to any individual, entity or third parties for any reason without the specific written consent of the
client, with the exception as required by Law, Regulation, Governmental Authority or for client orders.
JordanTBH Technologies are also committed to protecting and securing all client provided information through the use of firewalls and additional security
measures in place at its physical facilities to protect against the loss, misuse or alteration or such information.
We reserve the right to display any or all work done for our clients throughout our website and print advertisements, and may use testimonials received in
promotional campaigns. We will not attempt to identify individuals through their IP addresses; with exception as required for violations of Law, Regulation,
Terms of Service or Governmental Authority.
